Woman displeased about appearing on People of Walmart

What is this world coming to? Detroit resident Melanie Wheeler saw her mom on People of Walmart and, frankly, she does not approve:
"You can't be safe in a store while you're shopping? It upsets me."

Wheeler said that, in her opinion, these pictures are different than those taken by paparazzi on a public street or sidewalk.

"The thing is if you take a picture of someone in public, they're in public," she said. "My argument is you're in a Walmart. We have no privacy shopping? … So, I could go into any store and take a picture of anybody or their children and put it up on a web page."

Makes perfect sense. She doesn't like the publicity, so she goes on the news to make sure everyone knows her mom was on People of Wallmart.

Yet another obese American, I guess the next logical step is to sue somebody... maybe camera manufacturers? or to sue the Internet!

A Photographer’s Rights:

1. You can make a photograph of anything and anyone on any public property, except where a specific law prohibits it.

e.g. streets, sidewalks, town squares, parks, government buildings open to the public, and public libraries.

2. You may shoot on private property if it is open to the public, but you are obligated to stop if the owner requests it.

e.g. malls, retail stores, restaurants, banks, and office building lobbies.

3. Private property owners can prevent photography ON their property, but not photography OF their property from a public location.

4. Anyone can be photographed without consent when they are in a public place unless there is a reasonable expectation of privacy.

e.g. private homes, restrooms, dressing rooms, medical facilities, and phone booths.

5. Despite common misconceptions, the following subjects are almost always permissible:

* accidents, fire scenes, criminal activities

* children, celebrities, law enforcement officers

* bridges, infrastructure, transportation facilities

* residential, commercial, and industrial buildings

6. Security is rarely an acceptable reason for restricting photography. Photographing from a public place cannot infringe on trade secrets, nor is it terrorist activity.

7. Private parties cannot detain you against your will unless a serious crime was committed in their presence. Those that do so may be subject to criminal and civil charges.

8. It is a crime for someone to threaten injury, detention, confiscation, or arrest because you are making photographs.

9. You are not obligated to provide your identity or reason for photographing unless questioned by a law enforcement officer and state law requires it.

10. Private parties have no right to confiscate your equipment without a court order. Even law enforcement officers must obtain one unless making an arrest. No one can force you to delete photos you have made.

BORING VIDEO!!! What the hell, BIOTV why did i sit through 2 minutes of this crap? I was hoping for a little freak out from the ginger, but she just kept on talking bla bla bla and then the reporter went bla bla bla ... if i wanted to be bored i could've just put on CNN the got this crap going on 24/7....

You are being filmed as soon as you leave the house by traffic cameras. As soon as you pull into the parking lot by security cameras. As soon as you walk through the door by anti-theft cameras. Everybody reading this can find a picture your home on Google satellite picture websites in about 3 minutes. Welcome to America 2011. You have few rights and it's gonna get worse thanks to teabaggers full of fear and crap.

People of walmart only has no names and only the state the store was in. So this woman went on the site, saw her mother, TOLD her mother then called the news and now the whole town knows. Plus we now know her town and name.
Yeah, that makes sense.

I agree with those who said, good job, you're bringing more attention to the fact, and I commend zeighy for posting those rights. People get so damned uptight about it but really photographers do have many more rights than people assume (which I think is a great thing).

Now, as for the eyebrow-less woman, here's a good rule of thumb to follow if you don't want your picture taken by people looking to poke fun at you. If you wouldn't want your picture taken of you in the state you are in... DON'T LEAVE YOUR HOUSE.

eh Late to the party for commenting but as someone in law school- Sue baby. People are winning ridiculous law suits everyday, I can guarantee you that you'll get some money out of this. The 3 guys who started it are;
Luke Wherry, Adam Kipple, Andrew Kipple.

Get a lawyer and take them to court, with enough publicity, you AND every other person who gets together and sues will wipe them out finacially eventually. They're all about humiliating, well that's fine but for me it's about the money. If someone appeared on that site or their book, it's not your fault if you felt emotionally devasted, too depressed to leave your house, or God forbid...possible blood pressure spikes, I mean they impacted your heath after all by all the humiliation you and others received from total strangers recognizing you after all. SUE BABY and even better, get a class action together. There's someone people need to remember... THERE'S LOOP HOLES EVERYWHERE!!!
